Pemohon Isbat Nikah, Kebanyakan Warga Pemalang Selatan

PUSKAPIK.COM, Pemalang-Pengadilan Agama (PA) Kabupaten Pemalang tahun ini menerima 140 perkara pengajuan isbat nikah. Dari angka tersebut 134 terselesaikan, 1 perkara ditolak, 1 perkara diputus tidak bisa diterima, dan 4 perkara yang gugur.

Juru bicara PA Pemalang, Sri Rokhmani, Jumat 6 November 2020 menyampaikan, dari jumlah tersebut terjadi kenaikan dari tahun sebelumnya yang hanya 100an perkara untuk pengajuan isbat nikah.

Isbat nikah sendiri adalah permohonan pengajuan pengesahan nikah yang diajukan ke pengadilan untuk dinyatakan sah-nya pernikahan dan memiliki kekuatan hukum tetap.

“Tren-nya naik dari tahun ke tahun, tahun ini kami lakukan persidangan terpadu dengan menggandeng Disdukcapil dan KUA. Dilaksanakan tanggal 23 Oktober kemarin di kantor Kecamatan Watukumpul, ” ujarnya.

Dari jumlah yang diisbatkan sebagian besar masih didominasi oleh masyarakat Pemalang Selatan.

“Karena mungkin tradisi, menikah di usia muda di bawah 19 tahun, terutama pada sang istri atau mempelai wanitanya, sehingga hanya dilakukan secara siri karena secara undang-undang (hokum positif) tidak diperbolehkan, ” ungkapnya.

Sri mengatakan, implikasi pernikahan secara siri yakni, tidak dapat perlindungan secara hukum, baik suami, istri, atau anak.

“Yang jelas ketika proses pengajuan akta anak akan terkendala, karena dokumen pernikahan orang tuanya berupa buku nikah tidak ada. Maka dari itu kami berikan upaya pembuatan dokumen tersebut dengan proses isbat nikah. Tentunya hanya diperuntukkan kepada pernikahan siri yang tidak bermasalah, atau tidak ada ikatan pernikahan dengan yang lain, ” katanya.

Menurut Sri, berbeda dengan poligami, kalau poligami prosesnya mengajukan langsung ke pengadilan dengan diketahui saksi istri yang sah.

“Kami imbau masyarakat yang melakukan pernikahan secara siri agar mengajukan isbat nikah. Manfaatnya agar ikatan pernikahan diakui oleh negara dan terjamin secara hukum hak-haknya terutamanya hak anak, ” ujarnya.

Dan untuk para pemuka agama di desa-desa, agar bisa menyampaikan pesan dakwahnya kepada warga untuk melaksanakan pernikahan di hadapan petugas KUA setempat. Bagaimanapun pernikahan harus sah secara hukum negara dan syariat agama keduanya tidak boleh dipisahkan, ” pungkasnya.
